Supreme Court issues stay order allowing CJ Karki to carry out office functions

2017-05-06, rss.np

The Supreme Court has issued an interim order to keep the impeachment motion registered in the Legislature-Parliament against Chief Justice Sushila Karki in status quo and let her carry out her office functions from today itself.

A single bench of Justice Cholendra Shamsher JBR issued this stay order in the name of the Legislature-Parliament to keep the impeachment motion in status quo and let the Chief Justice carry out her duties from today's date itself based on the principle of balance of convenience until this petition was settled.

The order reads: Although it is seen the impeachment has been brought considering the case related to the promotion of the Inspector General of Police, which is sub-judice at the Supreme Court, the basis for the same was prima facie not clear and in consonance with the letter and spirit of the constitution.

Chief Justice Karki faced an automatic suspension after 249 lawmakers from the two major ruling partners- Nepali Congress and the CPN (Maoist Centre)- registered an impeachment proposal against her at the Legislature-Parliament Secretariat on April 30.
